Carlin Zoning Lawsuit Continues

No, the lawsuit between the Carlin Lake property owners and the owners of Carlin Club Properties is not over!  
 
Of course, even you good friends might assume that Trig Solberg and the water bottlers have been stopped in their pursuit to market “Carlin Water.”  Because, yes, both the district court and the Wisconsin Court of Appeals have ruled in our favor—that the trucking and pumping would violate county zoning ordinances.
But, at a hearing in April 2019, Judge Neal Nielsen questioned the language of the county zoning ordinances, and the appropriate interpretations of prior case law.  In one part of the judge’s directions, for example, he asks for clarification of language like “retail stores and commercial services” and “sales, service and repair.”
Judge Nielsen has directed this new complaint from Trig’s lawyers back to the Vilas County Board of Adjustment, with a public hearing set for November 14 at 9:00 am at the Vilas County Courthouse.    
As usual, we believe it is very important to have supporters attend these hearings.  Your presence demonstrates that this issue affects not only Carlin Lake but potentially, the water from any lake in Vilas County.  We know many people may be away during November, but will appreciate any of you who may be able to attend the hearing on November 14th.
And, in a semi-related issue, the Presque Isle Board of Supervisors have conditionally renewed the liquor license for the Carlin Club, in spite of the fact that the restaurant has not been open for years.  Trig’s lawyers assured the town supervisors that a chef has been hired to run the restaurant and that it will be open by November 1st.
(Although I can’t speak for all Carlin Lake property owners, many of us believe it is in the best interest of the lake and of our properties to have the Carlin Club open again as a successful restaurant.  However, we are understandably opposed to putting any dollars into the pockets of the bottling investors.)
